The agreement between you and The Satvik Origin when you browse, order or create an account.

Overview

Welcome to The Satvic Origin. These Terms of Service ("Terms", "Terms of Service", "we", "us", or "our") govern your access to and use of the The Satvic Origin website, online store, content, products, features, tools, and related services (collectively, the "Services").

The Services are operated by The Satvic Origin Private Limited and are powered by Shopify.

By visiting, browsing, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and the policies referenced in them, including our Privacy Policy and applicable Refund, Return, Shipping and Delivery policies.

Please read these Terms carefully before using the Services. If you do not agree with these Terms, please do not use or access the Services.

These Terms are intended to operate subject to applicable law. Nothing in these Terms is intended to exclude, restrict, or limit any consumer right or legal protection that cannot lawfully be excluded or limited.

Section 2 - Our Products

We make reasonable efforts to ensure that product descriptions, images, specifications, availability, and other product information displayed on the Services are accurate and up to date.

Product colours and appearance may vary depending on your device, display settings, lighting, photography, and other factors. Such differences do not necessarily mean that a product is defective or materially different from its description.

Our products may have natural variations associated with their materials, manufacturing process, fragrance, packaging, or other characteristics.

We may update product descriptions, specifications, packaging, pricing, or availability from time to time. We may discontinue products or limit quantities where reasonably necessary, subject to applicable law and any rights arising from an order already accepted by us.

Nothing in these Terms limits rights you may have under applicable consumer protection law.

Section 3 - Orders And Acceptance

When you submit an order through the Services, you are making an offer to purchase the products selected by you.

After you submit an order, you may receive an order acknowledgement. An acknowledgement confirms that we have received your order request; it does not necessarily mean that the order has been finally accepted.

An order is accepted when we confirm acceptance or otherwise begin fulfilment, subject to applicable law.

We may decline, cancel, or limit an order where permitted by law, including where a product is unavailable, there is an obvious pricing or product-information error, payment cannot be verified, we reasonably suspect fraud or misuse, or there is another legitimate reason preventing fulfilment.

If we cancel or materially change an order after payment has been received, we will arrange an applicable refund in
accordance with our Refund Policy and applicable law.

Please review your order carefully before submitting it. Cancellation requests after an order has entered fulfilment may not be possible.

Your purchases are subject to our applicable Refund, Return, and Shipping and Delivery policies.

Section 4 - Prices, Taxes and Billing

Prices displayed on the Services are stated in Indian Rupees unless otherwise indicated.

Prices, discounts, offers, and promotions may change from time to time. The price applicable to your purchase will generally be the price displayed when you place your order, subject to correction of obvious errors and applicable law.

Applicable taxes and shipping charges, where any, will be displayed during checkout or otherwise communicated before you complete your purchase, unless stated otherwise.

Promotional offers may have additional terms. If the specific terms of a promotion conflict with these Terms, the specific promotional terms will apply to that promotion.

You agree to provide accurate and complete information necessary to process your purchase and to keep relevant information current where necessary.

Payment transactions are processed through payment service providers available at checkout. You must use a payment method that you are authorised to use.

Section 5 - Shipping & Delivery

We currently offer delivery within India through the shipping and logistics options made available at checkout.

Shipping charges, delivery options, and applicable thresholds or offers will be displayed at checkout or on the relevant Shipping and Delivery information page.

Delivery dates or timeframes shown on the Services are estimates unless expressly stated otherwise. Actual delivery may be affected by carrier operations, weather, holidays, address issues, service availability, or other circumstances outside our reasonable control.

You are responsible for providing an accurate and complete delivery address and contact information.

If a parcel cannot be delivered because of an incorrect or incomplete address, refusal, failure to receive the parcel, or another circumstance attributable to the customer, additional shipping or rescheduling charges may apply where permitted by law.

Nothing in this section limits any consumer rights you may have regarding non-delivery, damaged goods, defective products, or other matters under applicable law.

Section 6 - Returns, Refunds and Cancellations

Returns, refunds, replacements, and cancellations are governed by our applicable Refund and Return Policy, together with any rights available to you under applicable law.

Please review the applicable policy before purchasing.

Where a product is damaged, defective, incorrect, or otherwise eligible for a remedy under applicable law or our policies, please contact us promptly with your order details and relevant information or photographs where appropriate.

We reserve the right to require reasonable information necessary to verify an order, return, refund, replacement, or other request.

Nothing in these Terms is intended to remove or restrict any mandatory consumer rights.

Section 7 - Product Use and Safety

Our incense and dhoop products are intended to be used only as described on the product packaging and applicable product information.

Follow all instructions and safety cautions supplied with the product.

For The Satvic Origin dhoop products, the packaging instructs users to hold the stick horizontally and light it, shake it gently until activation, and use a dhoop holder while it burns. The packaging also instructs customers to keep the product away from flammable materials and out of reach of children and pets, burn it in a well-ventilated area, never leave it unattended, and place it on a heat-resistant surface.

The product packaging also advises consulting a physician before use if pregnant or if you have respiratory conditions.

Never use a product contrary to its instructions, warnings, or applicable safety requirements.

Product information on the Services is not medical advice and should not be relied upon as a substitute for advice from a qualified healthcare professional.

Section 8 - Intellectual Property

The Services and their contents, including but not limited to the The Satvic Origin name and logo, trademarks, product names, product imagery, photographs, text, graphics, designs, videos, audio, reviews, page layouts, and the selection and arrangement of content, are owned by or licensed to The Satvic Origin and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for your personal, non-commercial purposes.

Except as permitted by applicable law or with our prior written permission, you must not reproduce, distribute, modify, publicly display, publicly perform, publish, create derivative works from, sell, or commercially exploit our content or intellectual property.

The Satvic Origin names, logos, product names, designs, and slogans are trademarks or trade dress of The Satvic Origin or their respective owners. You may not use our trademarks without prior written permission.

All rights not expressly granted to you are reserved.

Section 9 - Customer Reviews and Feedback

If you submit a review, comment, photograph, suggestion, idea, testimonial, or other content to us ("Feedback"), you represent that you have the necessary rights and permissions to submit that content.

You grant The Satvic Origin a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, adapt, and distribute your Feedback for purposes connected with operating, improving, promoting, and providing the Services, subject to applicable law.

We may moderate, edit, refuse to publish, or remove Feedback where we reasonably believe it is unlawful, misleading, abusive, defamatory, obscene, fraudulent, infringes another person's rights, contains malicious code, or otherwise violates these Terms.

You remain responsible for the Feedback you submit and must not impersonate another person or submit misleading information about its source.

We do not guarantee that every submitted review or Feedback will be published or retained.

Section 10 - Third-Party Services and Links

The Services may include functionality, tools, integrations, payment services, analytics, reviews, shipping services, or links provided by third parties.

Third-party services are provided under the terms and policies of the relevant third party. We are not responsible for third-party services that we do not control, except to the extent responsibility cannot lawfully be excluded.

If you leave our website or interact with a third-party service, you do so subject to that third party's terms and privacy practices.

Our inclusion of a third-party link or integration does not necessarily constitute an endorsement of that third party.

Section 11 - Relationship With Shopify

The Satvic Origin's online store is powered by Shopify, which provides the ecommerce platform used to offer our products and Services.

Any purchase you make through our store is a transaction between you and The Satvic Origin. Shopify is not the seller of our products and is not responsible for the products sold by us, except as may otherwise be required by applicable law.

Shopify may provide infrastructure and services that support the operation, security, payments, analytics, and other functions of the store. Your use of the Services may therefore also be subject to Shopify's applicable terms and policies.

Section 12 - Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, retain, and protect personal information.

Our Privacy Policy forms part of these Terms by reference.

Because our store is hosted on Shopify, Shopify may also process certain information in connection with its platform and services. Please review our Privacy Policy and Shopify's applicable privacy documentation for further information.

Section 13 - Errors, Inaccuracies and Omissinos

We make reasonable efforts to keep information on the Services accurate, but occasional typographical errors, inaccuracies, omissions, outdated information, or technical errors may occur.

Where permitted by law, we reserve the right to correct errors, update information, change product availability, correct pricing, or cancel an affected order where an obvious error has occurred.

If an order is cancelled because of an obvious pricing or product-information error after payment has been received, we will provide an applicable refund.

Nothing in this section limits rights that cannot legally be limited.

Section 14 - Prohibited Uses

You may use the Services only for lawful purposes.

You must not use the Services:

For any unlawful, fraudulent, deceptive, or malicious purpose;
To violate applicable laws or regulations;
To infringe intellectual-property, privacy, or other rights;

We may suspend or restrict access where reasonably necessary to protect the Services, our customers, our business, or third parties, subject to applicable law.

We may make third-party tools, features, applications, or integrations available through the Services.

Such tools may be provided by third parties and may be subject to their own terms and privacy policies.

Where we do not control a third-party tool, we are not responsible for the third party's operation of that tool, except where responsibility cannot lawfully be excluded.

Any new features, tools, or resources added to the Services will also be subject to these Terms unless separate terms are provided.

Section 16 - Suspension and Termination

We may suspend, restrict, or terminate your access to the Services where reasonably necessary, including where you materially breach these Terms, engage in unlawful or fraudulent activity, misuse the Services, or create a security or operational risk.

Where appropriate and legally required, we may provide notice or an opportunity to remedy the issue.

Termination or suspension does not affect rights or obligations that arose before termination.

Provisions that by their nature should continue after termination, including intellectual property, Feedback, privacy, disclaimers, limitation of liability, indemnification, dispute provisions, and governing law, will continue to apply to the extent permitted by law.

Section 17 - Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "as available" basis and we do not guarantee that the website will always be uninterrupted, secure, timely, or error-free.

We make reasonable efforts to provide accurate product and website information, but we do not guarantee that every piece of content will always be complete, current, or free from errors.

Nothing in these Terms excludes or limits any warranty, guarantee, consumer right, or statutory protection that cannot legally be excluded or limited.

For products, the applicable rights and remedies available to you may arise from our policies, the product packaging, applicable law, and the circumstances of the purchase.

Section 18 - Limitation of Liability

To the fullest extent permitted by applicable law, The Satvic Origin and its directors, officers, employees, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Services, except where such liability cannot legally be excluded.

Nothing in these Terms limits liability for matters that cannot lawfully be limited or excluded, including liability that cannot be excluded under applicable consumer-protection law.

Where liability can lawfully be limited, our liability will be limited to the extent permitted by applicable law and the circumstances of the relevant claim.

Section 19 - Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless The Satvic Origin and its directors, officers, employees, affiliates, contractors, licensors, and service providers from third-party claims, losses, liabilities, or reasonable costs arising directly from your material breach of these Terms, unlawful use of the Services, or infringement of another person's rights.

This provision does not require you to indemnify us for matters caused by our own unlawful conduct or for liabilities that cannot legally be transferred to you.

We will provide reasonable notice of a claim where practicable. We may participate in the defence or settlement of a claim where appropriate.

Section 20 - Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions will continue in effect.

Section 21 - Waiver; Entire Agreement

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

These Terms, together with the policies and terms expressly incorporated by reference, constitute the agreement governing your use of the Services and supersede prior versions of these Terms concerning the same subject matter.

If there is a conflict between these Terms and a specific policy, the specific policy will govern the subject matter addressed by that policy, unless applicable law requires otherwise.

Section 22 - Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by applicable law.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or similar business transaction, subject to applicable law.

Section 23 - Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights or jurisdictional protections available to you under applicable law, disputes arising from or relating to these Terms or your use of the Services will be subject to the jurisdiction of the courts having appropriate jurisdiction in Mumbai, Maharashtra.

Nothing in this section prevents you from exercising any consumer rights or remedies available under mandatory applicable law.

Section 24 - Heading

Section headings are included for convenience and do not affect the meaning or interpretation of these Terms.

Section 25 - Changes to These Terms

We may update or replace these Terms from time to time to reflect changes to our business, Services, technology, legal requirements, or other operational needs.

The latest version will be posted on our website with an updated "Last updated" date.

Where required by applicable law, we will provide additional notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree with revised Terms, you should stop using the Services.
